Kevin Spacey’s lawyers: encounter was ‘mutual and consensual flirtation’

Kevin Spacey pleaded not guilty to sexual assault as he appeared in court over claims he groped an 18-year-old male bar worker.

Nantucket District Court Judge Thomas Barrett ordered Spacey to stay away from his accuser and the man's family.

According to State Police reports filed in court and to Spacey's attorneys, the alleged victim was in contact with his then girlfriend via Snapchat, text messages and phone calls during the incident inside the Club Car bar on July 7, 2016. At the hearing, Spacey's attorney, Alan Jackson, noted the lack of corroborating witnesses and that the young man was not interviewed by police until a year after the incident.

The next court appearance is scheduled for March 4. Spacey will not be required to appear at that pre-trial hearing, as long as he is available by phone, the judge ruled.

Spacey's alleged victim was working as a bus boy for the summer in Nantucket and had remained in the bar after his shift finished to see his hero.

It's the first criminal case brought against the 59-year-old after a string of sexual misconduct allegations crippled his career in 2017.

He is accused of groping an 18-year-old waiter.

"By reporting the sexual assault, my client is determined an encouraging voice for those victims not yet ready to report being sexually assaulted", the alleged victim's attorney told E! "Spacey stuck his hand inside my son's trousers and grabbed his genitals", Unruh said.

This is not the first time he is facing sexual assault allegations.

Spacey had sought to avoid attending the arraignment in person, arguing that his presence would "amplify the negative publicity already generated in connection with this case".

The accuser's mother told reporters in November 2017 that Spacey got her son drunk and then grabbed his genitals.

If convicted of felony indecent assault and battery, the 59-year-old two-time Oscar victor could face as many as five years in prison. "You're smarter than that", Spacey said in the video.

On the same day he was charged in December, Spacey released a weird YouTube video in which he spoke in character as House of Cards' Frank Underwood to deny the allegations.

The first public report of alleged abuse by him came from actor Anthony Rapp, who claimed that Mr Spacey sexually abused him when Mr Rapp was 14, in 1986.

After the formal charge against him was announced, Spacey released a video in which he seemed to attempt to refute the charges.
