Legal luminaries on Tuesday hailed the Supreme Court verdict on the practice of triple talaq among Muslims, by terming it as "historic, progressive and path- breaking", which would restore the equality, dignity and respect of crores of women.

During the hearing, the then Attorney General of India, Mukul Rohatgi had said that all forms of talaq must be abolished and if such a thing is done by the court, then the government will indeed enact a legislation to regulate Muslim divorces.

India's Supreme Court on Tuesday banned the controversial Muslim practice that allows men to instantly divorce their wives, saying it is unconstitutional, in a ruling that favors women's rights but which some fear will inflame tensions between Muslims and the country's Hindu majority.

It has thus been struck down in effect. The bench, which had judges from five faiths, passed this in a 3-2 verdict in which Chief Justice of India JS Khehar was in minority.

The BJP also wanted a uniform civil code to end the interference of religious laws in civil codes. The practice stands in clear contradiction of that right to equality.

The Rajya Sabha member said Prime Minister Narendra Modi in one of his speeches referred to triple talaq, but "did not utter a single word on women's reservation bill".

"Triple talaq is against the basis of sharia [Islamic law]. what is said to be bad in the Holy Koran can not be good in sharia", Justice Kurian Joseph said, talking about the practice in question.

BJP MP Subramanian Swamy welcoming the decision said, "Chief Justice has given an astute order; Stayed Triple Talaq for six months and asked Parliament to get off its backsides and legislate". However, the trials of the triple talaq divorce have been a violation of the fundamental rights of women. They were also of the opinion that the verdict would protect the Muslim women, who could now march towards the path of progress and prosperity like any other citizen of India. It's a historic day for Muslim women.

Muslim women usually divorce using a practice called Khula.

Three judges also said that the practice of divorcing through three divorces is obviously voluntary. "Traditions like Triple Talaq are like mental and social harassment of our sisters and daughters and are an impediment in the progress of modern Indian society", Chouhan tweeted. "It is going to be a great herculean task to implement this on ground", ANI quoted AIMIM leader Asaduddin Owaisi as saying.
